We accept liability only for acts committed fraudulently that caused a loss resulting from your non-performance under this Agreement (in addition to our normal payment limits) and all other losses are not payable.

21. Exclusion of Liability

Nothing in Our Terms & Conditions will exclude or limit any liability which cannot be excluded at law including:

• death;
• injury

This includes cases where We, through a third party acting on its behalf (including employees), commit a breach causing you an irreparable loss such as emotional damage or physical harm.

22. Governing Law

The laws of England will apply to and govern these Terms & Conditions with the court of English law having exclusive jurisdiction over any dispute arising out of this Agreement including claims for non-performance by both parties

Any changes or modifications made to the current terms are immediately binding upon you.

If there is no clear expression here, but can be implied in the circumstances such a term will also govern.
